I remember when this topic came up before and at the time I thought you missed one important detail. Having done 4 short sales all listed with the Greenwich mls, I can tell you that before the bank accepts or rejects an offer they do their own appraisal of the home and a hire independent real estate professionals to conduct a BPO (broker price opinion). There was absolutely no harm in the listing broker presenting this offer to his client and the bank because the bank would ultimately have been the entity to decide whether to reject or accept it. If I remember correctly I thought your numbers were very low but that would have been up to the bank to decide, not the owner. It is one of the few times when emotions should not get in the way of a deal. It is pretty much black and white and the owner and the broker would have suffered nothing from submitting the offer to the bank. I also think based on the numbers I recall that your offer would have been rejected but then the negotiation takes place with the bank until the buyer agrees or walks. At any rate, the broker should have remained neutral and simply submitted the offer and let the bank decide whether to accept, reject or negotiate. I've found the short sale homes generally end up selling right at about fair market value because of the system the banks have in place. It might be a lot lower than the current mortgage on the home but I have not seen any that traded ridiculously below their market value. In a recent short sale I did, the first buyer walked because the bank came back after their appraisal and said they had to increase their offer. The buyer passed and we moved on to the next buyer who came in higher. I'm glad in my short sale experiences, I was smart enough to work with the bank to get the deal done for all parties involved. No one wants these deals done more than the buyer and seller. The broker missed the big picture and really did not work on his seller's behalf as far as I can tell.
